The NLRB dropped its complaint over SpaceX’s alleged illegal firings after concluding SpaceX is a “common carrier by air” covered by the Railway Labor Act and therefore exempt from the National Labor Relations Act.
SpaceX shifted out of NLRB labor jurisdiction
Why it matters
The case seeking reinstatement, back pay, and other remedies for eight terminated employees will no longer proceed under NLRB processes, changing the forum and legal pathway for similar claims. SpaceX labor disputes now route through the National Mediation Board under Railway Labor Act procedures, which impose longer dispute-resolution steps and make strikes harder to execute. This reclassification reduces near-term leverage for SpaceX employees pursuing collective action and changes compliance expectations for SpaceX’s labor-relations playbook.
