European Parliament and Council adopt Regulation 2026/1184 on railway infrastructure capacity

Railway infrastructure managers must apply the Regulation's EU capacity-allocation rules when assigning train paths in the single European railway area

Change
On 20 May 2026 the European Parliament and Council adopted Regulation (EU) 2026/1184 on the use of railway infrastructure capacity in the single European railway area, amending Directive 2012/34/EU and repealing Regulation (EU) No 913/2010; it was published in the Official Journal on 10 June 2026.
Why it matters
The Regulation creates a binding EU legal framework governing the allocation and use of railway infrastructure capacity across the single European railway area and removes Regulation (EU) No 913/2010 as the governing instrument. Infrastructure managers and railway undertakings are now required to operate under the Regulation's capacity-use and allocation rules rather than the repealed framework. As it amends Directive 2012/34/EU, national implementation of the amended directive provisions should also be tracked.
Implications
  • Railway infrastructure managers must update capacity-allocation procedures to conform to Regulation (EU) 2026/1184 when assigning train paths across the single European railway area, or allocations will be non-compliant with EU law.
  • Railway undertakings operating across the single European railway area must request and use infrastructure capacity under the rules established by Regulation (EU) 2026/1184, since the prior Regulation (EU) No 913/2010 framework is repealed.
