India's Ministry of Electronics and Information Technology (MeitY) amended the Information Technology Rules, 2021 to bring user-posted news and current-affairs content under Part III oversight and to require intermediaries to comply with MeitY advisories and takedown directions under Section 79, removing Section 79 safe-harbour protection for platforms that do not act on government notices.
Why it matters
Intermediaries are required to follow any clarification, advisory, order, direction, standard operating procedure, code of practice or guideline issued by India's Ministry of Electronics and Information Technology under Section 79. Rule 3(b) denies safe-harbour protection if platforms do not remove content after being legally informed, and an inter-departmental committee can review grievances and order takedowns of user-posted news.
